Brooke Jenkins Sworn As San Francisco’s New District Attorney

By Mayor London Breed

After an extensive and lengthy process that included meetings with community members, business owners and attorneys, I appointed Brooke Jenkins as San Francisco’s new District Attorney for her prosecutorial and personal experience that has equipped her to best understand both sides of the criminal justice system.

Brooke is a Bay Area native, received her J.D. from the University of Chicago Law School and B.A. from UC Berkeley. She served as an Assistant DA in the San Francisco DA’s Office from 2014 to 2021, where she worked her way up, serving in the Misdemeanor and Felonies Units before working as the office’s Hate Crimes Prosecutor. She was later promoted to the Sexual Assault Unit and eventually the Homicide Unit.

She resigned from the San Francisco DA’s Office in October 2021 as a result of mounting dissatisfaction with the direction of the office. At the time of her departure, she prosecuted over 25 criminal jury trials and completed more than 100 preliminary hearings.

I hear from residents every day that they are frustrated with the state of accountability in our city and have real concerns about feeling safe, but they also don’t want us to move back on the progress we have made reforming our criminal justice system. I will do all that I can to work with our new District Attorney to ensure that we can restore faith in the system while staying true to the promises we have made.

Brooke will serve until November, when she will then run during a special election which will decide who will complete the previous District Attorney’s term through 2023.

I sincerely hope that you will join me in support the work that she will do to protect our community’s safety.

Call To Action: Support Crime Prevention And Investigation

Right now, the San Francisco Police Department is barred from accessing any live video to solve or prevent crime except if there is imminent danger of serious injury or death. This leaves neighborhoods across the city vulnerable to organized criminal activity, such as the mass looting, gun violence, drug dealing, and burglaries that have happened in the city over the past several years.

Tomorrow, July 18th, at the Rules Committee, the Board of Supervisors is considering legislation that I support and am sponsoring would give law enforcement limited, temporary authority to use video footage to help deter, investigate, and solve crime.

They need to hear that residents, workers, large and small business support the use of these tools to help improve public safety in San Francisco.

What to do:

Call and email your supervisor and let them know that you support this legislation to help improve public safety in San Francisco.

Call in to the Monday, July 18th, Rules Committee hearing at 10:00 AM to make your voice heard.

PUBLIC COMMENT CALL-IN 1 (415) 655-0001

MEETING ID: 2483 435 9050 # #

Tell your friends, coworkers, neighbors about what’s happening and ask them to weigh in too — anyone who understands that we need to care about and invest in crime-fighting and crime prevention tools.

Highlights of the legislation:

Currently, the police are barred from accessing or monitoring even temporarily, live video that is owned or operated by third parties unless there are “exigent circumstances” — this is defined as circumstances that involve an imminent danger of serious physical injury or death

If this standard is not met, the police cannot access live video even on a temporary basis

This intentional blinding of law enforcement does not make sense and it does not make us safer.

Organized crime, whether it’s mass looting in Union Square or drug dealing rings in the Tenderloin, or retail theft in Chinatown or brazen home burglaries on the Westside — these are all criminal activities that law enforcement can address more effectively if they have their eyes open

This legislation will allow police to use non-City cameras and camera networks during large scale events with public safety concerns; for investigations of active misdemeanor and felony violations; and investigations into officer misconduct

There are strong guardrails against misuse of this technology

including the right of the owner or operator to refuse any request for access, a mandate for there to be written requests for access that are auditable upon demand, training for command level staff as well as any officer who would have access to video, and explicitly barring using video to target anyone for exercising their First Amendment rights

Video footage can be used as evidence as well to exonerate individuals who may be wrongly accused and help police and prosecutors ensure that they are holding the correct persons responsible
