華埠的「殘障人士法案」

上週,我出席了中華總商會舉行的會議,宣布巿府正支援受到殘疾人士無障礙訴訟影響的華埠小商業。

在過去的一個月,市內不少小商業收到了訴訟或要求信,指控他們違反了聯邦殘障人士准入法,特別是違反了美國殘障人士法案 (ADA)。雖然商戶和業主正與律師和社區機構合作以回應這些指控,但市府的資源來幫助這些商戶亦非常重要。

我知道各商戶都明白《美國殘障人士法案》保障的權利,並且也非常重視無障礙的環境,因為大家都希望為我們的所有遊客和居民提供商品和服務.

我們亦明白小商業仍在努力掙扎求存。市府亦一直以不同方式支援小商業,讓商戶重新站起來並蓬勃發展。

三藩市亦會幫助確保商戶遵守無障礙要求,我們知道商戶都希望能滿足這些要求,但亦可能需要一些協助才能完成。

我已經了委託市行政官朱嘉文召集市府必要的部門及職員,確保我們將所有資源集中在一起以幫助現有及將來的小商業。

我們齊心協力支持這個社區,撥備了5萬元用於檢查,以幫助確定建築物入口是否達標,需要進行哪些修復。我們還在加快重啟50萬元撥款,用於檢查和修復,其中包括建築成本。該基金原定於 2022年1月重啟,但我們正努力加快這些撥款的發放,幫助現時出現了的緊急需求。

ADA Lawsuits in Chinatown ——By Mayor London Breed

Last week, I joined a meeting held by the Chinese Chamber of Commerce to announce the City’s efforts to support small businesses impacted by disability access lawsuits in Chinatown.

Over the past month, there have been lawsuits filed and demand letters sent to small businesses citywide alleging violations of federal disability access laws, specifically violations of the Americans with Disabilities Act (ADA). While merchants and property owners are working with attorneys and community service providers to respond to these allegations, it is critical for the City to allocate resources to help these merchants.

I know that our merchants share the commitment to including rights guaranteed by the Americans with Disabilities Act, and also take accessibility very seriously because small businesses also want to share the goods and services that they work so hard to provide to our visitors, workers and residents.

We also know that small businesses are still trying to recover. Many of them have struggled, and are still struggling, to survive. And we’ve been there to help support them because this City’s economic recovery depends in large measure on getting you all back on your feet and thriving.

The City is here to support small businesses to help them ensure that they are in compliance with accessibility mandates, which we know they want to successfully meet, but may need some help to accomplish.

I have asked our City Administrator, Carmen Chu, to convene the necessary departments and city staff to make sure that we are putting everything on the table to help the small business community today and into the future.

Together, we are pulling together to support our community with immediate access to $50,000 for inspections to help determine whether a physical building entrance is accessible, and if it is not, what is needed to fix it so that it is accessible. We are also expediting the re-start of the Disability Access Fund with a minimum amount of $500,000 for inspections and remediation, which includes construction costs. This Fund was slated to re-start in January 2022 but we are working to expedite the release of those funds for the urgent needs arising today.

I want our Chinatown businesses to know that we are here to help and I want to make it clear that their successes are directly tied to our City’s economic recovery. And I want to thank the Chinese Chamber of Commerce and Chinatown Merchants Association for working with the merchants and bringing this issue to my attention.
